What you should know about the States to avoid!
There are no Federal laws when it comes to Surrogacy thus creating the legalities for Surrogacy to vary from state to state. Although there are many states that are surrogacy friendly, here are a few states to avoid.
The following states practice Surrogacy but can be tricky when it comes to certain legalities of your surrogacy journey:
Idaho
New York
Tennessee
Virginia
Wyoming
If you reside in any of the above states, please be sure to consult with an attorney that specializes in Fertility Law.
The following states practice surrogacy but will not acknowledge a Surrogacy Agreement/Contract:
Arizona
Indiana
In the above states, courts will typically issue a parentage order but surrogacy contracts are void and unenforceable.
The following states should be avoided at all cost when it comes to a surrogacy journey:
Louisiana
Michigan
Nebraska
The above states law prohibits compensated surrogacy contracts or birth certificates naming Intended Parent(s) cannot be obtained.
